What is the Family and Medical Leave Act?

 

The Family and Medical Leave Act is a federal statute in the US that protects employees’ jobs by allowing them to take up to twelve weeks of leave for specific medical and family reasons.

 

The FMLA allows eligible employees to take up to 12 weeks of unpaid leave within 12 months.

 

  • Birth and care for a newborn;
  • Adoption or foster care
  • Care for a member of the family who is in a serious medical condition.
  • A serious illness renders the employee unable to do their job.

 

How do you file Washington Paid Family and Medical Leave?

 

You can follow these steps if you’re a Washington State worker who must apply for Paid Medical and Family Leave.

 

Find out if you’re eligible for PFML: You qualify for PFML if you worked at least 820 hours during the qualifying period, the first four of the five completed calendar quarters.

 

Notify your employer: If you are eligible for leave under the PFML Program, you must notify your employer 30 days or sooner.

 

Create a paid family and medical leave account: To create a paidleave.wa.gov account, you must provide your name, social security number, and contact details.

 

Submit Your Application: After creating an account, you may submit your PFML application online. You must provide details about your leave, the length of time you plan to stay, and any other supporting evidence.

 

Show medical certification: Those on leave due to serious health issues or a family member’s condition can show a medical certificate as proof.

 

Start receiving benefits: After your claim has been approved, you’ll receive weekly benefits payments during your leave. Your benefit amount will depend on your earnings and your reason for leaving.

 

How Many States Have Paid Family and Medical Leave?

 

California, Colorado, Connecticut, Delaware, Hawaii, Maryland, Massachusetts, New Jersey, Oregon, Puerto Rico, Rhode Island, New York, Washington, DC, and Washington, DC, have all passed legislation requiring paid leave due to a significant disability or health condition.
